The Failure of the 28-Clause Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the introduction of a new 28-point plan for ending the war appeared – momentarily – to have been contained. A senior US official spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its countermove: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the current period. By day, political struggles are conducted: positive announcements are released from different nations. Significant resources is devoted on restraining specific proposals. By night, the Kremlin clearly shows the world that, for them, military action persists as the main instrument for achieving "settlement".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was revealed. Ukraine is capable of detecting missile launches from enemy soil, a ability afforded by timely intelligence. From observation points, military aircraft that had been dispatched to intercept incoming aerial threats roared overhead – modern combat jets delivered to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons activated: several firings fired to intercept a incoming threat. This was a advanced protection mechanism at work, probably supplied through partner states. Every launch creates sudden vibrations, causing tremors. The brief panic quickly becomes sober acceptance: perhaps the hostile projectile won't hit its mark this time, preventing destruction from devastation and further power outages.

Ongoing Risks

Soon after, a large-caliber weapon fired at a unmanned aircraft close by, part of a rapid response unit – almost certainly imported technology. Regrettably, the shots failed to hit the enemy aircraft – it maintained course toward its objective.

With pauses, this carried on until dawn. Kyiv greeted the early updates: multiple fatalities, devastation and utility failures in multiple buildings as a result of the night's assault. As always, everyone still went about their day – enduring hostilities. But those 24 hours illustrated Ukraine's vital need on Western support – a need that neighboring countries are evidently unprepared to fill in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington provoked deep reactions, debate and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new proposal from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They stabilise the situation but never actually win the battle. This cycle will, certainly, endure.

Tactical Assessments

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the complete picture. American leadership functions according to a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The US administration believes that it is unfeasible to compel Moscow to surrender the territory that it already controls in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, Washington does minimal to prevent Kremlin actions, through statements or actions, from thinking that the situation will not shift further in its advantage in the coming year.

Opposing Positions

Therefore, Moscow is convinced that time is on his side – that Ukraine and its supporters are nearing depletion. Their incentive to agree to terms that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's leadership remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding civilians and areas but avoiding a complete military breakdown until conditions improve in its benefit.

Present Conditions

Objectively, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: personal goals to negotiate peace and secure international recognition, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the country's interests against any proposal Kyiv finds unacceptable, so that their priority does not switch to homefront challenges. And although their objective will now be much harder after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Summary and Prospects

It took a only one week to eliminate the proposed articles of the current initiative. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the remaining European nations, along with calming attempts of diplomats, and finally, latest revelations, all achieved their purpose.

While new proposals based on previous concepts are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are rooted in Kremlin requirements and demonstrate specific hesitation to change the course of events, if they maintain solidarity and enhance their military capacity at a much faster pace. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the coming months, largely rely on continued Western support.
